Terms of Service
1. Acceptance of Terms
By accessing, purchasing, subscribing to, or using any service, product, software, script, digital good, or feature provided by FixedFarm (“the Service”), you as the user (“User” or “you”) acknowledge that you have read, understood, and agreed to be irrevocably bound by these Terms of Service (“Terms”). If you do not agree with any provision of these Terms, you must immediately cease all use of the Service.
Use of the Service in any manner, including merely browsing the website or using free features, constitutes ongoing acceptance of the most current version of these Terms. FixedFarm reserves the right to update or modify these Terms at any time (see Section 10), and it is your responsibility to review them periodically. Your continued use of the Service after any changes signifies your acceptance of the revised Terms.
2. Eligibility and Age Restrictions
Legal Capacity: The Service is offered only to individuals and entities who are legally capable of forming binding contracts under applicable law. By using the Service, you represent and warrant that you have the legal capacity to enter these Terms. If you are an individual, you must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher). If you are under 18 but at least 13 years old, you may only use the Service under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms. Users under the age of 13 are strictly prohibited from using the Service. FixedFarm may, at its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. Access to or use of the Service is void where prohibited by law.
Location Restrictions: It is your responsibility to ensure that your use of the Service is lawful in your jurisdiction. FixedFarm makes no representations that the Service is appropriate or available in any particular location, and accessing the Service from territories where its contents or practices are illegal is prohibited. You are solely responsible for compliance with local laws and regulations.
3. Description of Services
FixedFarm provides a range of digital products and services, including but not limited to:
- Roblox Scripts and Software: Custom scripts, executors, or software tools intended for use with the Roblox™ platform across multiple games. These are typically used to modify or automate gameplay.
- Digital Products & Services: Various intangible digital goods, software, or content delivered electronically. This may include game-related utilities, enhancements, or digital downloads.
- Subscription-Based and One-Time Purchases: Access to certain scripts, software, or digital services may be sold as recurring subscriptions or as one-time purchases, depending on the offering. The features and duration of each subscription or product will be specified at the time of purchase.
- Third-Party Related Services: Services or access related to third-party platforms, which may include (for example) Spotify® premium access, virtual currency or in-game currency services for games, or other account-based services not owned by FixedFarm. These offerings involve facilitating access or use of third-party services but are not official products of those third parties (see Section 4).
All offerings are digital, intangible goods or services delivered electronically. FixedFarm reserves the right to modify or discontinue any aspect of the Service or any product offering at any time (see Section 10). You acknowledge that the nature of the services (such as game scripts or account accesses) may require you to have active accounts with the relevant third-party platforms (e.g., a Roblox account to use Roblox scripts, a Spotify account to use any Spotify-related service). You are solely responsible for maintaining your own third-party accounts and for any fees or compliance associated with those accounts.
4. No Affiliation or Endorsement
FixedFarm is an independent provider of digital goods and is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Roblox Corporation, Spotify AB, or any other third-party company, platform, game, or service unless explicitly stated. Any references to third-party names or services (such as “Roblox” or “Spotify”) are for identification or description purposes only. All trademarks, service marks, and trade names referenced in the Service remain the property of their respective owners. Use of such marks does not imply any affiliation with or endorsement by them. You acknowledge that no partnership, joint venture, employer-employee, or agency relationship exists between FixedFarm and any third-party service provider by virtue of your use of our Service.
Because FixedFarm is not affiliated with these third-party platforms, we have no control over their decisions or actions. We do not guarantee that any scripts or services provided for use with a third-party platform are in compliance with that third party’s terms of service or policies. It is your responsibility to review and comply with any relevant third-party terms when using our products with their services (see Section 11 and Section 12 for more). FixedFarm explicitly disclaims any liability for the consequences of using our Service with any third-party platform.
5. Services Provided “AS IS” and at Your Own Risk
All FixedFarm services, products, scripts, software, and digital goods are provided “AS IS” and ?AS AVAILABLE,“ entirely at the User”s own risk. To the fullest extent permitted by law, FixedFarm disclaims all warranties and representations of any kind, whether express, implied, or statutory, including but not limited to:
- Implied Warranties: Any and all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and those that may arise from a course of dealing or usage of trade are expressly disclaimed.
- Quality and Performance: FixedFarm does not warrant that any product, script, or service will meet your requirements or expectations, or that it will achieve any intended result. All performance, functionality, and results from using the Service are your sole responsibility and risk.
- Availability and Uptime: FixedFarm makes no guarantee that the Service (or any part of it) will be uninterrupted, timely, secure, or free from errors, bugs, or viruses. Any downloadable software or script is used at your own discretion and risk, and you are solely responsible for any damage to your computer system, network, or loss of data that results from the download or use of any such material.
- Accuracy and Reliability: We do not warrant the accuracy, completeness, or reliability of any information or output obtained through the Service. Any information or content obtained through the Service is for general use and at your own risk, and you should independently verify it before relying on it.
- Support and Updates: While FixedFarm may occasionally release updates, patches, or new versions for its scripts or software, we are under no obligation to provide ongoing support, maintenance, or updates. We do not guarantee that any defects or errors will be corrected, or that updates will be compatible with your system or with changes to third-party platforms. Future updates could alter or remove functionalities.
By using the Service, you acknowledge and agree that you assume all risk associated with its use. Any reliance on the Service is at your own discretion and peril. FixedFarm and its owners, developers, and affiliates do not warrant or guarantee in any way that the Service will be suitable, accurate, reliable, or safe. All materials and information are provided with all faults and without warranty of any kind. If applicable law does not allow the exclusion of certain warranties, our liability will be limited to the minimum extent permitted.
6. No Guarantees of Functionality or Continued Availability
FixedFarm provides no guarantee or assurance that:
- Functionality: Any product, script, or software will function as described or as intended on any particular platform or at any particular time. For example, scripts intended for use on Roblox or other games may cease to function or become detected by anti-cheat systems after game updates or changes outside our control.
- Uptime and Availability: The Service, including websites, servers, download links, or any associated online features, will be continuously available or free from interruption. We may experience downtime, outages, maintenance periods, or removal of content at any time, without notice.
- Longevity of Support: Any given script, software, or service will remain available or supported for any minimum duration. FixedFarm may decide to discontinue or modify a product line or feature at its sole discretion (see Section 10). Users should not rely on the continued availability of any specific feature or product.
- Updates and Compatibility: The scripts or services will remain compatible with third-party platforms (like Roblox or Spotify) after those platforms update their software or policies. We do not guarantee that we will adapt our products to changes made by third parties. Users have no entitlement to any updates or modifications.
- Security: The Service will be secure or immune from unauthorized access or hacking. While we may implement security measures, all software (especially tools like executors or scripts that interface with games) inherently carry some risk. For example, some antivirus or security programs might flag or block our software; we offer no guarantee to avoid detection by such systems or by game anti-cheat mechanisms.
- Data Integrity: Use of the Service will not result in data loss or corruption. Any account data, configuration, or digital content could be lost, wiped, or corrupted and we do not provide backups or restoration unless explicitly stated.
All use of the Service is with the understanding that no guarantees are made by FixedFarm. Temporary or permanent unavailability of any product or feature, or failure of any item to function as intended, does not constitute a breach of these Terms by FixedFarm. These are inherent risks that you accept by using the Service.
7. All Sales Final – No Refunds, No Chargebacks
ALL SALES ARE FINAL. By purchasing or subscribing to any digital product or service from FixedFarm, you agree that no refunds, returns, or exchanges will be given under any circumstances. This policy is absolute and without exceptions, including (but not limited to) cases of: dissatisfaction with the product, inability to use the product (whether due to third-party bans or technical issues on your end), change of mind, finding a similar product elsewhere, or any other reason. Once a purchase is made and the digital goods or access are delivered or made available to you, the transaction is permanent and irrevocable.
Specific conditions of this No-Refund policy include:
- No Chargebacks or Reversals: You explicitly agree not to initiate any chargeback, dispute, reversal, or payment cancellation with your bank, credit card provider, PayPal, or any payment processor. Attempting to circumvent our no-refund policy through a chargeback or similar dispute is considered fraudulent conduct and a material breach of these Terms. FixedFarm reserves the right to dispute any chargeback and to provide these Terms and your acceptance of them as evidence that you agreed to the purchase being final and non-refundable.
- Consequences of Chargebacks/Disputes: If you initiate a chargeback or payment dispute for a transaction that has been completed, FixedFarm reserves the right to immediately terminate all your access and licenses to the Service, to ban you from future use of our services, and/or pursue legal action or debt collection efforts to recover any reversed amounts (plus any fees incurred). We also reserve the right to report your information (such as username, email, IP address) to industry fraud databases or partners, which could affect your ability to make purchases with other vendors.
- Digital Nature of Products: You acknowledge that all products and services provided are intangible digital content or licenses that are delivered instantly or made accessible at the time of purchase. As such, there is no way to “return” these products in a way that guarantees they have not been copied or continued to be used. This is a primary reason for our strict no-refund policy.
- User Responsibility: It is your responsibility to ensure that your computer, device, or third-party accounts meet all requirements (technical, legal, or otherwise) for using the product before you make a purchase. Lack of compatibility, lack of required third-party subscriptions, or inability to use the product due to your environment are not valid grounds for a refund. If you are unsure about any product’s functionality or requirements, you should refrain from purchasing or contact us with questions in advance of any purchase.
For consumers located in the European Union: By purchasing any digital good or service from FixedFarm, you expressly consent to immediate performance and delivery of the digital content and waive any statutory right of withdrawal or “cooling-off” cancellation period that may be provided under EU law or your local laws for digital content. We provide access to digital content immediately upon purchase, and therefore, to the maximum extent permitted by law, no 14-day withdrawal right (under the EU Consumer Rights Directive or applicable national legislation) applies. If such rights cannot be waived or excluded, you agree that any request to exercise a statutory cancellation right must be communicated to us in writing and that you will delete, destroy, and make no further use of any digital content you obtained from us.
By agreeing to these Terms, you acknowledge that this No-Refund Policy is reasonable due to the nature of the products. You further agree that your purchase and use of the Service signifies your acceptance of these strict refund terms.
8. Digital Delivery and Completion of Service
Once a digital product, script, software license, account access, or service is delivered, activated, or made available to you (including by providing a download link, license key, login credentials, or any form of access), the service is considered fully provided and complete from FixedFarm’s perspective. All risk of loss, deletion, or damage to the digital goods transfers to you upon delivery. FixedFarm has no obligation to re-deliver, re-activate, or provide any replacement for digital content that has been delivered, whether you have downloaded it or not, and regardless of any subsequent loss of access on your part.
Key points regarding digital delivery:
- Delivery Definition: Delivery shall be deemed occurred when the digital product or service has been made accessible to you via electronic means. This could be, for example, the moment a script or file is available for download in your account or sent to your email, or when your user account is granted access to a members-only area, or when credentials for a third-party service (like a premium account access) are provided to you.
- Finality: After delivery, you are solely responsible for the safekeeping of the digital goods. FixedFarm strongly encourages you to make backup copies (if applicable and permitted) of any software or scripts and to securely store any provided credentials or license keys. We will not be responsible if you lose the product or can no longer access it due to deletion, hardware failure, or account issues on your side or on a third-party platform.
- No Replacements: We do not guarantee replacement of lost, forgotten, or stolen digital goods. For example, if you purchase a script and later lose the file, or if you are given an account or key and lose access to it (due to your actions or third-party actions), FixedFarm is not obligated to provide a new copy or new account. Any replacement or assistance we provide in such situations is at our sole discretion and as a courtesy, not an obligation.
- Third-Party Revocation: If a third-party service (e.g., Spotify or a game platform) revokes or disables an account or access that was provided to you as part of our Service (for instance, if a Spotify premium account we provided is later terminated by Spotify), that is considered beyond our control and still constitutes a completed delivery on our end. You assume the risk that third-party providers may take action that impacts your access (see also Section 11). Such occurrences do not entitle you to any replacement, credit, or refund from FixedFarm.
In summary, digital goods are deemed delivered and final once you have access to them. FixedFarm’s obligations are fully fulfilled at that point. You must use and manage the goods responsibly from then on, at your own risk.
9. Right to Refuse Service and Termination
FixedFarm reserves the absolute and unconditional right to refuse service to, suspend, restrict, or terminate any User’s access to the Service at any time, for any reason or no reason at all, and without prior notice or liability. This right to termination or suspension may be exercised, for example (but not limited to), in the following circumstances:
- Breach of Terms: If you violate any provision of these Terms or any other policy or guideline that is part of the Service, your access may be immediately terminated or suspended.
- Suspected Fraud or Misuse: Any indication that a purchase is fraudulent, that a payment method is unauthorized, or that you are involved in activities such as attempting chargebacks (see Section 7), exploiting our services, sharing access with others, or any form of misuse or abuse of the Service, may result in immediate account termination.
- Illegal or Harmful Activity: If we suspect that you are using our Service in connection with illegal activities, or activities that could harm other users, third parties, or the integrity of our systems or products (for example, using our scripts to conduct fraud, or attempting to hack our servers), we may terminate your access without notice. We may also report such activities to law enforcement as appropriate.
- Obligation to Comply: We may terminate or suspend service if required to comply with law enforcement requests, court orders, or if mandated by law (for example, if providing the Service to certain users would violate export control laws or sanctions).
- No Obligation to Disclose: FixedFarm is not obligated to provide an explanation or justification for any refusal, suspension, or termination of service. The decision of FixedFarm will be final. We may, at our sole discretion, give a warning or explanation, but we are not required to do so.
If your service is suspended or terminated:
- No Access: You will immediately lose access to any paid services, scripts, or accounts provided by FixedFarm. You must cease any further use of any software or content obtained from the Service. FixedFarm may disable or revoke any licenses, keys, or accounts provided to you.
- No Refunds or Liability: Suspension or termination of service will be without any refund, credit, or liability to you whatsoever. FixedFarm shall not be responsible for any losses or damages that may result from termination of your access. This is a necessary risk you accept in exchange for access to our Service under these Terms.
- Potential Notification: FixedFarm may, at its discretion, notify relevant third-party providers or authorities if the termination was due to misuse, illegal activities, or violations of third-party terms (for example, informing Roblox Corp or another platform if we believe it’s necessary).
- Reactivation: FixedFarm has no obligation to restore access once terminated. Any decision to reactivate a suspended account or to allow a previously banned user to return would be at our sole discretion under any additional conditions we deem appropriate.
We further reserve the right to refuse future service to anyone who has been terminated or whom we decide, in our discretion, poses a risk to the company or the user community. FixedFarm’s exercise of the right to refuse or terminate service shall not waive or affect any other rights or remedies FixedFarm may have under these Terms or under the law.
10. Changes to Terms, Services, or Pricing
Modification of Terms: FixedFarm reserves the right to change, modify, add, or remove portions of these Terms at any time, in its sole discretion. We may also update other policies or rules (such as community guidelines, if any) at any time. Whenever material changes are made to the Terms, we will endeavor to provide notice to users (for example, by updating the “Last Updated” date at the top of this document, or via an announcement on our website or via email). However, it is your responsibility to review the Terms periodically for any changes. By continuing to use the Service after the Terms have been updated, you agree to be bound by the revised Terms. If you do not agree to any amended term, you must stop using the Service.
Modification of Services: FixedFarm may at any time, without liability, and without prior notice (although we may provide notice in some cases as a courtesy) modify, suspend, or discontinue any aspect of the Service, including:
- Changing or removing features or functionalities of software or scripts.
- Requiring or discontinuing user accounts or authentication measures. (For example, if currently services are provided without user accounts, FixedFarm may introduce mandatory account registration in the future, or vice versa.)
- Moving from a free to a paid model, or changing which content is free or premium.
- Modifying or discontinuing any third-party related service or access if the third-party’s policies or systems change, or for any business reason. (E.g., if Spotify changes its API or rules, we may cease offering Spotify-related services.)
- Imposing limits on usage (such as rate limits, or limiting the number of devices or accounts that can use a product).
- Shutting down the Service entirely (temporarily or permanently).
Pricing Changes: All prices for products, subscriptions, or services are subject to change. FixedFarm may alter the price of any service or product, or institute new fees or charges, at any time. If you have a recurring subscription, we will make a reasonable effort to notify you of significant price changes in advance. Your continued use of the Service or failure to cancel your subscription after a price change constitutes acceptance of the new price. All pricing is in the currency indicated at purchase and, unless stated, does not include any taxes that may apply. You are responsible for any applicable taxes.
Effect of Changes: Changes to services, features, or pricing may render old products obsolete or require you to upgrade. FixedFarm is not responsible for any loss or inconvenience suffered due to changes in the Service. We are also not obligated to maintain older versions or features for your benefit. By using the Service, you acknowledge that change is an inherent part of digital services, and you agree that FixedFarm will not be liable for any modification, suspension, or discontinuation of any part of the Service.
11. Third-Party Platforms and Consequences
Many FixedFarm products are designed to work in conjunction with third-party platforms or services (such as Roblox or Spotify). While using our Service, you are solely responsible for complying with all applicable third-party terms of service, policies, and rules. FixedFarm is not responsible or liable for your actions on third-party platforms or for the consequences those actions may incur. This includes, but is not limited to, the following:
- Account Bans or Suspensions: Using third-party-related services or game scripts may violate those platforms“ rules (for example, using unauthorized scripts in Roblox likely violates Roblox”s Terms of Use). FixedFarm is not responsible if your account on any third-party platform is warned, suspended, or permanently banned as a result of using our Service. You assume full risk of any enforcement action taken by third-party companies. We will not provide refunds or compensation for any losses (such as loss of a game account or subscription) resulting from third-party enforcement.
- Data Loss or Account Termination: If a third-party service (like a game or Spotify) deletes your account, removes your content, or otherwise restricts your access due to activities related to our Service, FixedFarm has no responsibility for such actions. We do not have the ability to intervene or restore third-party accounts.
- Third-Party Changes: Third-party platforms may change their systems, APIs, or terms in ways that negatively impact the functionality of FixedFarm’s offerings (for example, a game update might render a script unusable, or a platform might change its authentication so that our provided access no longer works). FixedFarm does not guarantee continued functionality in light of third-party changes. We are not liable for any loss of value or utility of our products due to such external changes. (See Section 6 regarding no guarantee of compatibility or updates.)
- Compliance with Third-Party Terms: It is your responsibility to read and follow the terms of any third-party service you interact with. If using our Service causes you to breach your agreement with a third party, you do so at your own risk and are solely responsible for the consequences. FixedFarm does not condone illegal or prohibited use of its products, even if the product itself can be used in such a manner. By using our Service, you agree that you will not use it to violate any law or any contract or terms of use you have with a third party.
- No Third-Party Support: We are not obligated to provide any support or liaise with any third-party on your behalf. For example, we will not intervene in disputes between a user and Roblox Corporation, Spotify, or any other provider. Similarly, do not contact third-party services for support regarding FixedFarm products — they are unrelated and will not assist with issues caused by unauthorized modifications or third-party service usage.
Acknowledgment of Risk: You explicitly acknowledge that interacting with third-party platforms through unofficial or unauthorized means (such as using game cheats, scripts, or account-sharing services) is inherently risky. Such activities are often against those services? rules and can result in serious consequences to you, including legal action in some cases. You choose to engage in these activities at your own discretion and peril. FixedFarm provides tools and services that might enable certain functionalities, but we do not encourage or endorse violating any third-party rules. Our products are provided for personal, lawful use, and any violation of third-party terms is strictly at your own risk.
12. User Responsibilities and Legal Compliance
By using the Service, you agree that you are solely responsible for your own conduct and any data, content, or resources on your devices or accounts that you use in connection with the Service. You further agree to use the Service only in compliance with all applicable laws, rules, and regulations, as well as in accordance with these Terms and any other policies fixed by FixedFarm. Key user responsibilities include:
- Compliance with Laws: You must comply with all local, state, national, and international laws and regulations applicable to your use of the Service. This includes (but is not limited to) intellectual property laws, anti-hacking laws, export control laws, data protection and privacy laws, and any laws regarding the exploitation of software or game services. If certain content or services offered by FixedFarm are not legal in your jurisdiction, you must not use or purchase them. FixedFarm assumes no obligation to ensure the Service is legal in your jurisdiction and will not be liable for your illegal use of it.
- Compliance with Platform Rules: As noted in Section 11, you are responsible for understanding and following any agreements you have with third-party platforms (e.g., game or service Terms of Use). If those rules prohibit the use of external scripts, bots, account sharing, or other activities facilitated by our Service, it is your responsibility to refrain from those uses or accept the risk of enforcement by the third party.
- Truthful Information: If and when FixedFarm requires you to create an account or provide information (for example, to make a purchase or to register for a subscription or newsletter), you agree to provide accurate, current, and complete information. You must not impersonate anyone or provide information you are not authorized to use. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Providing false information or using the Service on behalf of someone else without authorization is a violation of these Terms.
- Personal Use Only: Unless expressly authorized by FixedFarm, the products and services are for your personal and non-commercial use only. You are not allowed to use the Service for operation of a service bureau, or to provide services to others as part of any commercial activity (such as using our scripts in a paid service to boost other players, etc.) without a separate written agreement with FixedFarm.
- No Monitoring Obligation: FixedFarm is not responsible for policing user activity or for the way you use the digital products. We do not monitor or control (beyond technical measures we implement) what you do with the scripts or services. Thus, if you choose to use them in ways that are illegal or break third-party rules, you do so on your own initiative. We reserve the right (but have no obligation) to take action if we become aware of misuse, as detailed in various sections of these Terms (e.g., termination in Section 9, or legal action in Section 15).
Legal Consequences: You agree that if your use of the Service causes or contributes to any legal liability or consequences, you are fully responsible for the outcomes. For example, if you use a FixedFarm script to do something that violates a law or someone’s rights and you are fined or sued, you will resolve those issues at your own cost, and you indemnify FixedFarm from those (see Section 15). FixedFarm will cooperate with legitimate law enforcement requests and court orders as required, which may involve providing your information or information about your usage if properly subpoenaed or required by law, consistent with our Privacy Policy and applicable law. Using this Service does not grant you any immunity from legal action or consequences imposed by third parties or authorities.
13. Prohibited Uses and User Conduct
Users of FixedFarm must adhere to high standards of integrity and lawfulness. You agree not to engage in any prohibited activities, and understand that any breach of this section is grounds for immediate termination of your access (see Section 9) and potential legal action. Prohibited uses and conduct include, but are not limited to, the following:
- Unauthorized Sharing or Resale: You may not share, resell, distribute, or trade any FixedFarm products, scripts, accounts, or access credentials with anyone else. Licenses or access provided to you are strictly for your personal use. This means you cannot post our scripts publicly, upload them to any library, share them with friends, or resell them via any platform. If we detect that you have distributed our proprietary content to others (for free or for profit), it is a serious breach of these Terms.
- Reverse Engineering and Tampering: You shall not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas or algorithms of any software or scripts provided by FixedFarm, except to the limited extent that applicable law expressly permits despite this limitation. Additionally, you must not modify, crack, hack, or create derivative works of the software or scripts. Any attempt to bypass encryption, licensing checks, or security measures installed in our software is strictly prohibited.
- Exploiting or Abusing the Service: You agree not to use the Service in a way that could damage, disable, overburden, or impair any FixedFarm server or interfere with any other party’s use of the Service. This includes not attempting to gain unauthorized access to the Service or data (no hacking our systems, no DDOS attacks, no exploiting potential vulnerabilities). Also, using our scripts or services to harass, bully, stalk, threaten, or defraud any person or entity is forbidden.
- Illegal Activities: You must not use the Service for any unlawful purpose or in furtherance of illegal activities. This includes, for example, using our tools to steal someone’s data, to cheat in a way that constitutes fraud, to engage in copyright infringement (aside from authorized uses of our content), or to violate any law. If the digital goods can be used for illegitimate purposes, you are solely liable for any wrongdoing “ FixedFarm”s provision of the tool is not an endorsement of any illegal use.
- Content Restrictions: If the Service involves any content (like code, text, or information) provided by FixedFarm, you may not remove, alter, or obscure any proprietary notices (including copyright or trademark notices). If you are allowed to post or submit any content (for example, reviews or feedback on our site), you must not post anything that is unlawful, defamatory, infringing, or otherwise harmful. (Note: Currently, FixedFarm may not have user-generated content features; but if it does, the same rules apply.)
- Malware and Security Violations: You are prohibited from using the Service to distribute malware, viruses, Trojan horses, or any other malicious code. Also, you should not use our products in conjunction with other malicious software. For example, do not incorporate our scripts into a malware distribution system, and do not use our script executors to run malicious code. If our software interacts with third-party systems, you should use it only as intended by us, not in unintended ways that could be deemed as a security threat by those third parties.
Enforcement: FixedFarm reserves the right to investigate any suspected violations of this Section 13. Your use of the Service may be monitored (consistent with our Privacy Policy and applicable law) to enforce these Terms. If we suspect any prohibited conduct, we may take action including warnings, suspension or termination of access (Section 9), legal action, and disclosure of your actions and identity to law enforcement or affected third parties.
You understand and agree that breach of this section may cause irreparable harm to FixedFarm’s business, reputation, and intellectual property rights, for which monetary damages may be inadequate. FixedFarm reserves the right to pursue all remedies available under law or equity for such breaches. This may include injunctions to stop unauthorized use, as well as claims for damages and attorneys? fees.
14. Intellectual Property Rights
All content, software, code, scripts, products, and materials provided by FixedFarm (collectively, “FixedFarm Materials”) are owned by or licensed to FixedFarm and are protected by intellectual property laws and treaties. Unless otherwise expressly noted, FixedFarm retains all rights, title, and interest (including copyrights, trade secrets, patents, and trademarks) in the FixedFarm Materials and the overall Service.
License to User: Upon a valid purchase or as part of a valid subscription, FixedFarm grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the specific digital product or content you have purchased, solely for your personal, lawful, non-commercial use, and strictly in accordance with these Terms and any applicable license terms that accompanied the product. All rights not expressly granted to you are reserved by FixedFarm. This license is conditioned on your continued compliance with these Terms. If your access is terminated or expires (e.g., end of a subscription period without renewal), your license to use the associated content or service terminates, and you must cease further use.
No Ownership Transfer: Purchasing a digital product or service from FixedFarm does not transfer any ownership of intellectual property to you. You are not “buying the code” or the rights to the content; rather, you are purchasing a license or access to use FixedFarm’s content under the conditions herein. You must not claim any FixedFarm Materials as your own or assert any ownership rights in them. All FixedFarm trademarks, logos, and branding elements are the exclusive property of FixedFarm. These Terms do not grant you any right or license to use the FixedFarm name or any FixedFarm trademarks for any purpose (including promotional or commercial use) without our prior written consent.
Anti-Piracy and Anti-Leak Measures: FixedFarm takes the protection of its intellectual property seriously. We may include digital rights management (DRM), licensing verification, or other technical measures in our software or scripts to detect and prevent unauthorized use or distribution. You agree not to circumvent or attempt to circumvent any such measures. If we discover that our products have been leaked, shared, or distributed without authorization (for example, appearing on piracy forums or Discord servers), we reserve the right to disable the relevant licenses or accounts immediately and to pursue legal action against the offenders. We may also issue DMCA takedown notices or similar IP infringement notices to platforms hosting unauthorized copies of our content.
Feedback: If you choose to provide any feedback, suggestions, or ideas regarding the Service to FixedFarm (“Feedback”), you agree that FixedFarm is free to use and incorporate such Feedback in any manner, without restriction and without any obligation of compensation to you. Any Feedback you provide is entirely voluntary and will not be considered confidential or proprietary.
Third-Party Intellectual Property: We respect the intellectual property rights of others and expect users to do the same. You represent and warrant that you will not use the Service to infringe on anyone’s intellectual property. If, for example, you upload or submit any content through the Service (such as a comment or a customization of a script, if such features exist), you must have the rights to do so. FixedFarm has the right (but not the obligation) to remove any content that allegedly infringes another’s copyright or other IP rights. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, it is our policy to respond to proper notices of claimed infringement. If you believe any content on our Service infringes your copyright or other rights, you may notify us according to our Copyright/DMCA Policy (details of which can be provided upon request). Conversely, if you are a user who has content taken down due to a claim, and you believe it was wrongfully removed, you may submit a counter-notice as permitted by law
This Section 14 shall survive any termination of these Terms. Unauthorized use of FixedFarm’s intellectual property is a grave violation of these Terms and may also violate civil or criminal laws.
15. Limitation of Liability
No Indirect Damages: To the fullest extent permitted by applicable law, in no event shall FixedFarm, its owner(s), developer(s), employees, agents, partners, affiliates, or suppliers be liable to you or any third party for any indirect, incidental, consequential, special, exemplary, or punitive damages whatsoever arising out of or related to the Service or these Terms. This exclusion applies regardless of the theory of liability (contract, tort, negligence, strict liability, or any other theory) and includes, without limitation, any damages for loss of profits or revenue, loss of data, loss of use, loss of business opportunity, cost of procuring substitute services or goods, or any other intangible losses, even if we have been advised of the possibility of such damages.
No Direct Damages in Excess of Fees Paid: To the fullest extent permitted by law, FixedFarm’s total cumulative liability to you for any and all claims arising from or related to the Service or these Terms shall not exceed the total amount of fees actually paid by you to FixedFarm in the six (6) months immediately prior to the event giving rise to the liability (or, if the claims relate to a specific product, the fees paid for that product). If you have paid no fees to FixedFarm, FixedFarm shall have no liability whatsoever. This limitation is cumulative and not per-incident; multiple claims will not increase the cap
Assumption of Risk: You acknowledge and agree that the fees charged by FixedFarm (if any) for the products and services reflect the allocation of risk set forth in these Terms and that FixedFarm could not make the Service available to you on an economically feasible basis without the limitations of liability as stated herein. You hereby agree to this allocation of risk and release FixedFarm from any and all liability beyond the limitations stated.
Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. To the extent that such a law applies to you, some of the exclusions or limitations above may not apply to you, and you may have additional rights. In particular, nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law (for example, certain liabilities under EU law for personal injury or for willful misconduct or gross negligence). However, in any case, FixedFarm’s liability will be limited to the greatest extent permitted by law.
No Liability for Third-Party Actions: FixedFarm specifically disclaims any liability for any acts or omissions of third-party service providers or platforms (such as payment processors, web hosting companies, Roblox, Spotify, etc.), including any issues related to their services or any breaches of their security. FixedFarm is not responsible for any third-party disputes or problems, such as if a payment processor double-charges you or a game platform locks your account. Your sole remedy for issues arising from those third parties is with those third parties, not with FixedFarm.
This Limitation of Liability is an essential part of the bargain between you and FixedFarm, and it shall apply even if any limited remedy in these Terms is found to have failed of its essential purpose.
16. Indemnification
You agree to indemnify, defend, and hold harmless FixedFarm, its owner(s), developer(s), affiliates, partners, employees, agents, and licensors (“Indemnified Parties”) from and against any and all claims, causes of action, demands, losses, liabilities, damages, judgments, or expenses (including attorneys? fees and costs) arising out of or related to:
- Your Use of the Service: Any use or misuse of the Service by you or anyone using your account or credentials (whether or not with your permission), including but not limited to infringement of third-party rights, or violation of law, or game/platform rules caused by using FixedFarm products.
- Violation of Terms: Your breach of any provision of these Terms or any other agreement with FixedFarm, including any warranties or representations made by you herein.
- Third-Party Claims: Any claim by a third party arising out of or related to your use of the Service, such as claims that your use violates someone else’s rights (for example, if a game company asserts that your use of our script violated their terms or harmed them, or if another user claims you harmed them using our tools).
- Content or Data: Any content or data you obtain through the Service, or any content you post or submit (if applicable), including any claim that such content infringes or misappropriates the intellectual property, privacy, or other rights of a third party, or that it is defamatory or harmful.
FixedFarm reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with our defense of such claim and you shall not settle any such matter without the prior written consent of FixedFarm. You further agree to reimburse FixedFarm for any costs or expenses incurred in enforcing this provision.
This indemnity obligation shall survive the termination or expiration of these Terms and your use of the Service. The Indemnified Parties shall have the benefit of this section to the fullest extent permitted by law, and this indemnification is intended to apply regardless of any negligence (whether active, passive, or concurrent) of the Indemnified Parties.
17. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy (if available on our website) for details on how we collect, use, store, and disclose your personal information. By using the Service, you acknowledge that you have read our Privacy Policy and consent to the collection and use of your data as described therein. Some key points include:
- Data Collection: FixedFarm may collect certain personal information from you in order to provide the Service, process payments, and prevent fraud. This information may include, for example, your name, email address, billing information, IP address, and usage data. If user accounts are implemented, we will also store the credentials and any profile information you provide. All data will be collected and processed in accordance with applicable data protection laws.
- Use of Data: The personal data we collect is used primarily to deliver the products or services you have requested (e.g., to deliver digital goods, to provide customer support, to send important account or service updates). We may also use data to improve our offerings, to troubleshoot issues, or to enforce our rights under these Terms (for instance, using logs to investigate abuse). We will not sell your personal data to unrelated third parties for marketing purposes. We may share data with service providers who assist us (such as payment processors, email service providers, etc.), but only as needed for them to perform their services, and subject to appropriate confidentiality and security measures
- GDPR and EU Users: If you are in the European Union or a similar jurisdiction with comprehensive data protection laws, you have certain rights regarding your personal data (such as rights of access, correction, deletion, and portability, as well as the right to object or restrict processing in some cases). FixedFarm is committed to complying with the General Data Protection Regulation (GDPR) and other applicable laws. We will only process your personal data on a lawful basis (e.g., your consent, performance of a contract, or legitimate interests) and will implement appropriate technical and organizational measures to protect your data. For details on how to exercise your rights or contact us about privacy, see our Privacy Policy.
- Data Security: We take reasonable measures to protect the security of your personal data. However, you understand that no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. To the extent permitted by law, we are not liable for breaches of security and unauthorized access beyond our reasonable control. You also play a role in keeping your data secure by maintaining strong passwords and not sharing your account information (if applicable).
- Retention: We will retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including any legal, accounting, or reporting requirements. If you close your account or request deletion, we will delete or anonymize your personal data, except for information we are required or permitted to retain under law or for legitimate business purposes (such as maintaining transaction records).
- Law Enforcement: We may disclose your information to third parties if required by law, subpoena, or court order, or if we have a good-faith belief that such disclosure is reasonably necessary to (1) comply with legal obligations, (2) enforce these Terms or other agreements, (3) respond to claims that any content violates third-party rights, or (4) protect the rights, property, or personal safety of FixedFarm, our users, or the public.
By using the Service, you expressly consent to the collection, processing, and disclosure of your information as described above and in the Privacy Policy. If you do not agree with our policies or practices, you should not use the Service.
18. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to the Service or these Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the EU member state in which FixedFarm is established (within the EU), without regard to its conflict of law principles. If FixedFarm is not formally established as a legal entity in an EU member state, then for the purposes of this section, the governing law shall be the substantive laws of [Germany] (as the place of operation of FixedFarm), again excluding any conflict-of-law rule that would apply the laws of another jurisdiction.
Jurisdiction: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts of the jurisdiction of FixedFarm’s registered office or principal place of business. (For example, if FixedFarm is operated from Germany, then the German courts would have exclusive jurisdiction.) You and FixedFarm consent to the personal jurisdiction of such courts and waive any objections (including objections based on inconvenience) to jurisdiction or venue in those courts.
If you are a consumer residing in the European Union, you may have certain mandatory rights to bring actions in your country of residence under local consumer protection laws; nothing in this section is meant to limit any rights you have that cannot be varied by contract. However, in all other cases and to the extent permitted, you agree to the above governing law and jurisdiction.
Waiver of Jury Trial and Class Action (if applicable): To the extent allowed by law, both you and FixedFarm waive the right to a trial by jury in any litigation or proceeding arising out of or related to these Terms. Additionally, to the extent permitted by law, you agree not to participate in a class or representative action against FixedFarm, and any disputes shall be resolved only on an individual basis (this means no class actions). (Note: If such waivers are not enforceable in your jurisdiction, they do not apply.)
This Governing Law section is determined by our status in the EU and is intended to ensure that our legal risks are minimized by consolidating potential disputes in our home forum. You agree that any claim or cause of action you have arising out of use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred, unless a longer period is mandated by applicable law not waivable by contract.
19. Severability
If any provision of these Terms is held to be invalid, illegal, void, or unenforceable by a court or tribunal of competent jurisdiction, then that provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions. The remaining provisions of the Terms will continue in full force and effect. In such an event, the invalid or unenforceable provision shall be interpreted and enforced to the maximum extent permitted by applicable law, or replaced by a valid, enforceable provision that comes closest to the intention underlying the invalid provision. The purpose of this clause is to ensure that these Terms remain enforceable even if part of it is found unlawful or inapplicable.
20. Entire Agreement
These Terms of Service (along with any additional policies, guidelines, or terms expressly incorporated by reference, including the Privacy Policy and any product-specific license terms) constitute the entire agreement between you and FixedFarm regarding the Service and supersede all prior and contemporaneous agreements, understandings, negotiations, representations, and warranties, whether written or oral, related to the subject matter hereof. You acknowledge that in entering into these Terms, you have not relied on any statement, representation, warranty, or agreement other than those expressly set out in these Terms. Any additional or different terms proposed by you (for example, in any communication or purchase order) are hereby objected to and rejected by FixedFarm and will be of no force or effect.
No Oral Modifications: Any changes to this agreement must be made in writing and agreed to by FixedFarm. Communications (such as emails or support chats) that suggest alternate terms or promises will not override or modify these Terms unless an authorized representative of FixedFarm expressly agrees in writing.
21. No Waiver
No failure or delay by FixedFarm in exercising any right, power, or remedy under these Terms shall operate as a waiver of any such right, power, or remedy. No waiver by FixedFarm of any breach by you of any provision of these Terms shall be deemed to be a waiver of any subsequent or other breach of that provision or of any other provision. No waiver will be effective unless it is expressly stated by FixedFarm in writing and signed by an authorized representative of FixedFarm.
In other words, even if we do not enforce a part of these Terms in some instance, we do not waive our right to enforce it (or any other part of the Terms) in the future. Any single or partial exercise of a right or remedy by FixedFarm does not prevent further exercise of that or any other right or remedy.
22. Assignment
FixedFarm may, at its sole discretion, assign or transfer these Terms, or any of our rights or obligations hereunder, in whole or in part, to any person or entity (for example, in the event of a merger, acquisition, sale of assets, or by operation of law). You may not assign, transfer, or delegate any rights or obligations under these Terms without FixedFarm’s prior written consent, and any attempt to do so without consent will be null and void. These Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.
23. Additional Provisions
Headings: The section titles and headings in these Terms are for convenience only and have no legal or contractual effect.
Relationship of Parties: You and FixedFarm are independent contracting parties. These Terms do not create any agency, partnership, joint venture, or franchise relationship. You have no authority to bind FixedFarm or incur obligations on FixedFarm’s behalf.
Notices: Any notices or communications to FixedFarm under these Terms (for example, notices of copyright infringement, breach, or legal disputes) should be sent in writing to the contact address or email provided on the FixedFarm website. We may send you notices via email to the address associated with your account or purchase, via postal mail if you provided an address, or by posting an announcement on our website. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.
Force Majeure: FixedFarm will not be liable for any failure or delay in performance of its obligations (except payment obligations) to the extent caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil disturbances, embargoes, government actions, natural disasters, fire, epidemics or pandemics, labor disputes, power outages, interruptions of internet or communications networks, or failures of third-party service providers (a “Force Majeure”). In the event of a Force Majeure, FixedFarm’s obligations will be suspended for the duration of the event, and may, upon notice to you, be extended for a period equal to the delay caused by the Force Majeure.
Export Compliance: You agree to comply with all applicable export and import control laws and regulations in your use of the Service. You shall not use the Service if you are located in a jurisdiction where providing or using the Service is prohibited under U.N., U.S., EU or other applicable sanctions or export laws. You represent that you are not on any government prohibited or restricted party list.
Survival: Any provisions of these Terms which by their nature should survive termination (including, but not limited to, disclaimers of warranties, limitations of liability, indemnification, dispute resolution, and intellectual property provisions) shall survive the termination or expiration of these Terms and the termination of your use of the Service.
Language: These Terms are written in English. If these Terms are translated into another language and there is a conflict between the English version and the translated version, the English version shall prevail to the extent not prohibited by local law in your jurisdiction.
End of Terms of Service
By using or continuing to use the FixedFarm Service, you acknowledge that you have read these Terms of Service in their entirety and agree to be bound by them. If you do not agree, you must not use the Service.
